By accessing or using the NFTs Lab platform, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not access or use the platform.
NFTs Lab may modify these Terms and Conditions at any time and in its sole discretion. If we modify these Terms and Conditions, we will update the “Last Updated” date above. Your continued access or use of the platform after any such modification constitutes your acceptance of the new Terms and Conditions.
User Account
In order to access and use the NFTs Lab platform, you must create an account. You are responsible for maintaining the confidentiality of your account and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.
You may not assign or otherwise transfer your account to any other person or entity, and you may not share an account with another person. You acknowledge that NFTs Lab is not responsible for third-party access to your account that results from theft or misappropriation of your account.
NFTs Lab reserves the right to refuse or cancel service, terminate accounts, or remove or edit content at its sole discretion.
Privacy
Your use of the NFTs Lab platform is subject to our Privacy Policy. Please review our Privacy Policy to learn about our data collection practices.
Electronic Communications
Visiting the NFTs Lab platform or sending emails to us constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the platform, satisfy any legal requirement that such communications be in writing.
Links to Third-Party Sites/Third-Party Services
The NFTs Lab platform may contain links to other websites or services (“Linked Sites”). The Linked Sites are not under our control and we are not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. We are providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by us of the site or any association with its operators.
Certain services may be made available via the NFTs Lab platform and delivered by third-party sites and organizations. By using any product, service, or functionality originating from the NFTs Lab platform, you hereby acknowledge and consent that we may share such information and data with any third party with whom we have a contractual relationship to provide the requested product, service, or functionality on behalf of the platform’s users and customers.
Children Under Thirteen
NFTs Lab does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under the age of thirteen, you must not attempt to register for an account or submit any personal information to us.
Materials Provided to the NFTs Lab platform or Posted on Any NFTs Lab Web Page
We do not claim ownership of the materials you provide to the NFTs Lab platform or the assets you generate using the platform. You retain full ownership of any asset you submit, including those that contain private or personally identifiable information. You are solely responsible for the assets you make to the NFTs Lab platform, and you expressly agree to exonerate us from any and all liability, cost, or expense resulting therefrom.
We do not screen, edit, publish, transmit, or promote any assets. We do not assume any responsibility or liability for any assets posted by you or any third party, including without limitation for any correctness, legality, quality, copyright compliance, the legality of use, or any other harm resulting from your use of the platform or the Materials.
Materials generated or stored by NFTs Lab
Any assets uploaded to NFTs Lab or generated by NFTs Lab will be stored for a duration of ninety (90) days. After ninety (90) days, NFTs Lab will permanently remove all stored assets.
- Affiliate Program
The NFTs Lab Affiliate program offers you the opportunity to become an NFTs Lab Affiliate. To request to become an NFTs Lab Affiliate, you must provide an email address (this email address, which should be associated with your PayPal account, is used solely to send you payouts), at which point we may or may not approve your request to become an Affiliate. If approved, we will give you a unique promo code that allows you to earn a percentage of every NFTs Lab sale that uses your promo code, after fees. We reserve the right, in our sole discretion, to change the discount that your promo code provides as well as the percentage cut that you make from each sale and to terminate your affiliate ship at any time and for any reason.
International Users
The NFTs Lab platform is controlled and operated by us from the United States. If you access the platform from outside the United States, you do so on your own initiative and you are responsible for compliance with all applicable laws. You agree that you will not use the NFTs Lab platform or any content accessed through the platform in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.
Smart Contracts
While we will generate a smart contract, we are not responsible for the functionality of the contract and/or any bugs or issues that may arise from the use of the contract.
Indemnification
You agree to indemnify and hold us, and our officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney’s fees and costs, arising out of or in any way connected with your access to or use of the NFTs Lab platform or your violation of these Terms and Conditions.
Termination/Access Restriction
We reserve the right, at any time and in our sole discretion, to terminate your access to the NFTs Lab platform or any portion thereof, without notice.
Applicable Law/Jurisdiction and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect.
These Terms and Conditions constitute the entire agreement between us and you regarding the NFTs Lab platform, and supersede and replace any prior agreements we might have had between us regarding the platform.
